After product purchase and registration on the indicate web-site all users are bound to the User Legal Agreement and consent to all of the terms listed here.

PRIVACY POLICY

This policy outlines your rights pertaining to the use of your personal data and the usage of such by mSpy (www.mspy.com). The said policy applies solely to the data collected by the mSpy application and related web site, which may contain:

  1. Any personal data collected and how it is used by www.mspy.com and who the data may be shared with.
  2. All of your options relating to how you may use such data.
  3. Any actions performed with regard to safeguarding the confidentiality by our web site administration.
  4. Options available to regarding any correction of the said data.

Retention policy

This policy applies to all mSpy users with regards to our data retention. Once a user subscription expires (or is terminated) all logs and data pertaining to that user are deleted after a period of 90 days. Once this data has been deleted it cannot be recovered.

Information Collection, Use, and Sharing

mSpy owns all data held on its servers (and relevant off-line storage), but has no rights (either implicitly or explicitly) to sell, share, or rent this data to any 3rd party. Any personal data regarding your account may only be accessed by our system administrators to facilitate contacting you.

Only when your data is required by a 3rd party for purposes such as when billing information is required, that data will be passed on.

When purchasing mSpy you are required to provide us with a valid email account and your credit card details. You agree that we may use your email for notices such as promotional offers, application news or amendments to our policies.

You may opt out of these informational emails by contacting us and informing us that you do not wish to receive such.

Access to Your Data

Even when you opt out of informational material (see above) you may still contact our system administrators and request:

  • Information regarding what data (if any) mSpy holds about you.
  • That any of your information be changed.
  • That any part or all data about you and held by us be deleted.
  • To lodge a complaint about any use of your data by us that you deem to be inappropriate, or against our policies.
  • Information Protection

Protection, security and privacy of your confidential data are paramount to our business and all steps necessary are taken by us to safeguard them.

All confidential data you submit to us is done via a secure link (as per industry standards, your browser will show a lock icon and a web URL beginning with https:// to ensure that your connection is secured)

Various encryption systems are used to protect your on-line data, and any data held off-line (backups, etc.) can only be accessed by mSpy staff when said data is needed for specific tasks (eg. confirming a billing address).

Refund Policy

Before finalizing your purchase you should read the following carefully, as it outlines and governs aspects of your purchase pertaining to refunds and pre-purchase conditions.

If you are planning to install the software on an iPhone – the iPhone in question must be “jail-broken” – Instructions on how to perform this can be found here. (Our software will not function on a non jail-broken iPhone).

At this time mSpy does not support Windows Phone devices.

General

We are certain that any problems or queries you have regarding mSpy can be resolved by our support team. However, should you require a refund for your purchase you should take note of the following:

1. Refund Conditions

  • A full refund will be given within 10 working days of your purchase, where the refund is considered appropriate.
  • A refund will only be considered with regard to your 1st purchase of the application. Refunds are not available for the 2nd or subsequent purchases of mSpy and subscription extensions.
  • Refunds are not applicable where you have purchased 2 or more copies of our software.
  • If you have received a refund for a previous mSpy purchase, then purchased another – no refund will be considered.
  • Where mSpy was purchased at a discounted price – no refund will be considered.
  • No refund will be given where you have not accepted any updates to the software already installed on the target phone.
Premium Support Services

mSpy offers Premium Support Services for customers seeking a highly personalized level of technical assistance (help with Android rooting, phone support, etc.). This optional service is non-refundable and costs $9.99 (one-time payment). Customers that do not select mSpy Premium Support at the checkout will continue to have access to the standard mSpy support options, offered at no additional charge.

Force majeure Refunds will not be considered where the cause of complaint is outside the bounds of www.mSpy.com influence – these include:

  • The phone that has mSpy installed no longer has access to the internet – be it through lack of phone credit, lack of data signal, or alteration of your internet supplier’s policies.
  • Where the carrier (internet/phone supplier) has been changed and this has caused loss of internet connectivity.
  • The operating system of the target phone has been upgraded or changed to a version that is not supported by mSpy.
  • Where the target phone has undergone a hard (factory) reset.
  • Where the installation instructions and subsequent assistance by our support department were not followed correctly.
  • Where actual and physical access to the target phone was unavailable during the installation process.
  • If expected data is lost because the mSpy application has not been installed correctly (or at all).
  • Where the target device uses an unsupported operating system. These include: Symbian Belle, Windows Phone, BlackBerry 10 or Bada, iOS 7.1 and iOS 7.1.1
  • Where the customer expected (or attempted) to use the software on more than one device.
  • Ad-hoc reasons, being (but not limited to) “I bought it by mistake”, “I don’t like it” etc.
  • If a customer is not able to use WhatsApp, Skype, Viber, and Facebook features because the target Android deviсe is not rooted.
  • A customer is either unable or unwilling to jailbreak their iPhone.

2. Refund Procedure

Refund requests may not be made via Live-Chat, or by phone – they must be made via email only to refund@mspy.com. Your refund request will usually be processed within 1 or 2 working days, after which you will be notified of the outcome (and issued a full refund where your request was found to be appropriate).

If your refund was denied, your request will be given a “Dispute” status and you will be required to provide documentary evidence to support your claim within two weeks of your claiming becoming disputed.

Failure to supply said documentation with the time period given will close you claim and no further action will be taken.
